Please Note: In terms of the Protection of Personal Information Act, 2013 (Act No. 4 of 2013) (POPIA)
(1) In terms of the POPIA, the personal information of parents( as defined in the South African Schools Act) learners, educators ,non -educators and SGB members is protected and may not be disclosed to third parties unless so authorised by the POPIA.
This information related to the school has been provided solely for the education, administration, protection of learner’s constitutional rights and reporting purposes of the educational institution. The information is furthermore also provided for reporting and support purposes by the basic education sector as mandated by the Constitution of the Republic of South Africa,1996, National Education Policy Act ,1996 (Act No.27 of 1996) , National Education Information Policy, South African Schools Act No 84 of 1996 and other legal institutions such as but not limited to UMALUSI and SACE.
The unauthorised and unlawful disclosure by a responsible party of the personal information of a data subject may constitute an offense and lead to criminal sanctions in terms of the POPIA.
(2) Access to information on SA-SAMS is restricted to approved staff members only using a username and password that expires monthly and limited to certain information as per school security policy.
(3) School management are to ensure that all measures are taken to secure the electronic data from being illegally expropriated and provinces are to regulate the collection of data through secure processes.
(4) Using the Department of Basic Education's supported SA-SAMS application, you take responsibility of all efforts taken to protect access to the personal information provided and also consent to the use of the data as mandated.
